ABL Marketplace acts as an intermediary platform connecting buyers and sellers. We are not directly involved in the actual transaction between buyers and sellers.

All transactions are legally binding contracts between buyers and sellers
Sellers are responsible for accurate product descriptions and fulfillment
Buyers are responsible for reading product details before purchase
We reserve the right to cancel transactions that violate our policies

4. Seller Responsibilities

As a seller on the Platform, you agree to:

Provide accurate descriptions and images of products
Honor all sales and ship items in a timely manner
Comply with all applicable laws and regulations
Not sell prohibited, illegal, or counterfeit items
Maintain appropriate business licenses and permits
Pay applicable fees and commissions

5. Buyer Responsibilities

As a buyer on the Platform, you agree to:

Pay for all items you purchase
Provide accurate shipping information
Review products and sellers honestly
Contact sellers directly regarding issues
Follow the Platform's dispute resolution process

6. Prohibited Activities

You may not use the Platform to:

Violate any laws or regulations
Infringe on intellectual property rights
Transmit harmful code or malware
Engage in fraudulent activities
Harass or harm other users
Manipulate ratings or reviews
Scrape or collect data without permission

7. Fees and Payments

ABL Marketplace charges fees for certain services. Sellers agree to pay applicable listing fees, transaction fees, and commissions. All fees are non-refundable unless otherwise stated. We reserve the right to change our fee structure with advance notice.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by ABL Marketplace and are protected by international copyright, trademark, and other intellectual property laws. Users retain ownership of content they post but grant us a license to use it on the Platform.

9. Limitation of Liability

ABL Marketplace shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform. Our total liability shall not exceed the amount paid by you to us in the past six months.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, at our sole discretion. You may also terminate your account at any time by contacting us.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Platform. Your continued use of the Platform after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Kenya.
